Terms of Service

Welcome to ExamPen. These terms set out the rules for using our website and the CamPen app. We have kept them as plain as we can, so please take a moment to read them.
About ExamPen
ExamPen and the CamPen app are products of Exclr8 Business Automation (Pty) Ltd (“Exclr8”, “we”, “us”). These terms cover the CamPen app and the website at exampen.ai, together the “service”.
By creating an account or using the service, you agree to these terms. If you do not agree, please do not use the service.
Who can use ExamPen
ExamPen is built for high-school students preparing for their exams. To use it, you must be able to enter into this agreement.
ExamPen is currently offered to students at participating schools, rather than to the general public. Access is provided through an account set up for you, and the past papers and mark schemes in the service are made available for your own personal study only. You may not copy, share, or redistribute them.
If you are under 18, you may only use ExamPen with the permission of a parent or guardian, who agrees to these terms on your behalf and is responsible for your use of the service. Please read these terms together with a parent or guardian first.
Your account
You sign in using a Google, Microsoft, or Apple account. You are responsible for keeping your sign-in secure and for activity under your account. Please give us accurate details, use one personal account for your own use, and tell us promptly if you think someone else has accessed your account.
What CamPen does
The service lets you:
- Browse and download Cambridge past papers and mark schemes
- Practise papers in CamPen, writing answers with Apple Pencil or by submitting a photo of your handwritten work
- Get AI-generated marking and feedback on your answers
- Track your progress and review past attempts
AI marking is a study aid, not a guarantee
ImportantCamPen’s marking and feedback are generated automatically by artificial intelligence to help you practise and learn. It is guidance only:
- It can make mistakes and may not award marks the way a real examiner would.
- It is not official Cambridge marking and does not predict or guarantee the grade you will get in a real exam.
- Check anything important against your teacher or the official mark scheme.
You are responsible for your own exam preparation and results.
Cambridge papers and third-party content
ImportantPast papers, mark schemes, and related exam materials are the copyright of their respective owners, including Cambridge University Press & Assessment. Names and marks such as “Cambridge”, “IGCSE”, “O Level”, “AS & A Level”, and “Pre-U” belong to their respective owners.
ExamPen is an independent service. We are not affiliated with, authorised by, endorsed by, or connected to Cambridge University Press & Assessment, Cambridge International Education, or any examination board. This content is provided to help you revise, for your personal, non-commercial use only.
Subscriptions, payments, and tokens
Browsing and downloading past papers and mark schemes is free. AI marking is a paid feature, available through paid plans (such as Pro and Pro Max) and AI-marking tokens.
- Payment.You can buy plans and tokens through Apple’s in-app purchase in the CamPen app, and we may also offer payment on our website through a third-party payment provider. However you pay, the payment is handled by that provider and we do not collect or store your full card details.
- Auto-renewal. Subscriptions renew automatically unless you cancel before the period ends. Where you subscribed through Apple, you manage and cancel in your Apple ID settings; for any other method we will show you how to cancel.
- Tokens. Tokens pay for AI markings. They come with a subscription and can be topped up. They have no cash value, cannot be transferred, and are non-refundable once used, except where the law requires otherwise. Unused tokens may expire as described in your plan.
- Price changes. We may change prices or plans. Changes will not affect a period you have already paid for, and we will make reasonable efforts to give notice.
- Refunds. Refunds are handled under the policy of whichever provider you paid through (for example, Apple for App Store purchases).
Beta access
If you take part in a beta, such as a school pilot, access may be free and any AI-marking tokens may be granted by us rather than purchased. Beta software is still being tested: it is provided as-is, may be unstable, may contain bugs, and features may change or be removed. We may ask for your feedback, which we may use to improve the service.
Your answers and submissions
When you use CamPen you submit your own work, such as typed answers, handwriting, and photos of your written answers. You keep ownership of what you submit, and you give us permission to store and process it so we can provide marking, feedback, and your test history, as described in our Privacy Policy. Please do not upload other people’s personal information or anything unlawful.
Acceptable use
You agree to use ExamPen fairly and lawfully. You must not:
- Copy, scrape, redistribute, sell, or publish content from the service, except for your own personal study
- Use the service to cheat in, or gain an unfair advantage during, a real exam or assessment
- Reverse engineer, interfere with, or try to break or overload the service
- Share your account, or use the service on someone else’s behalf for payment
- Use the service in any way that breaks the law or another person’s rights
Our intellectual property
The ExamPen and CamPen apps, software, design, and the ExamPen and CamPen names and logos belong to us. We give you a limited, personal, non-exclusive, non-transferable, and revocable licence to use the service for your own studies. This does not include the third-party exam content described above, which belongs to its owners.
Availability and changes to the service
We work hard to keep ExamPen running, but we do not promise it will always be available or error-free. We may update, change, suspend, or stop any part of the service. Where a change is significant, we will make reasonable efforts to let you know.
Disclaimers and limitation of liability
The service is provided “as is” and “as available”. To the fullest extent allowed by law, we are not liable for indirect or consequential loss, for your exam results, or for any loss of data. Nothing in these terms limits any liability that cannot be limited or excluded by law, including under any applicable consumer protection law.
Suspending or ending your account
You can stop using ExamPen at any time and can ask us to delete your data, as set out in our Privacy Policy. We may suspend or close an account if these terms are broken, or to protect the service or other users.
Governing law
These terms are governed by the laws of the country in which ExamPen is established, and any disputes will be handled by the courts of that place.
Changes to these terms
We may update these terms from time to time. If we make a material change, we will let users know by email or on the website before it takes effect. Continuing to use the service after a change means you accept the updated terms.
